DOCUMENTS AND REQUIREMENTS FOR A MARRIAGE IN SOUTH AFRICA
(see below)

 

FOR A MARRIAGE BETWEEN TWO SOUTH AFRICAN CITIZENS

Parties must be 18 years or older.

2 coloured passport size photographs for each party.

Certified copies of ID documents of parties

Certified copies of ID documents of witnesses. (Witnesses must be SA citizens and over 16 years of age).
If either party has been previously married certified copies of Divorce Order or Death Certificate of deceased spouse must be lodged. It is important that the status of the parties are correctly reflected in the Population Register prior to the marriage.


FOR A MARRIAGE BETWEEN A SOUTH AFRICAN CITIZEN AND A FOREIGNER

Parties must be 18 years or older.

Prior to the marriage the parties must obtain a letter from the Marriage Officer addressed to the Immigration Officer at Department of Home Affairs setting out the time and place of the proposed marriage and that the Marriage Officer will officiate at the marriage.

The parties must then arrange for an interview with an Immigration Officer of the Department of Home Affairs, who will interview both parties and if satisfied that the proposed marriage is not a marriage of convenience, issue a letter that the parties may marry. The parties at the interview must have all relevant documentation available for scrutiny by the Immigration Officer, including the letter from the Marriage Officer, ID document, Passport of foreign party, entry permit, and if applicable work or residence permits.

The foreign party must also have available a Certificate of Non-impediment to marry issued by the country of origin of the foreign party. Once the interview has been conducted and is successful the following documentation will be required by the Marriage Officer:-

2 coloured passport size photographs for each party.

Certified copies of ID of SA party and Passport of foreign party as well as entry endorsements in foreign passport. 

Letter from Immigration Officer stating there is no objection to marriage taking place.

Certificate of non-impediment to marriage. Some countries do not issue such a certificate in which case I will draw the necessary affidavit.

Affidavit by foreign party that they do not have SA ID document. (I will draw the necessary affidavit).

Two SA witnesses are required and certified copies of their ID documents are required.


FOR A MARRIAGE BETWEEN TWO FOREIGNERS

2 coloured passport size photographs for each party

Certified copies of Passports of foreign parties as well as entry endorsements.

Certificate of non-impediment to marriage, issued by country of origin of foreign  parties. (if Certicate of non-impediment is in foreign language, English translation is required.)

If parties were previously married and divorced certified copies of divorce order (translated if necessary) must be lodged.

Affidavits that parties do not have SA Identity documents, (I will draw such affidavits)
